Abstract

A variety of social movements concerned with the defense of the cultural rights of ethnic minorities have pressed towards the institution of differentiated and collective rights for these groups during the last for decades in western countries. International organizations have thus responded with the creation of a regulatory framework on this issue, which has evolved in dialogue with reforms held within some national states, as in the case of Mexican reforms. The instruments that compose this framework have tended to favor these demands, but the notions of culture and identity implied in their formulations are usually based on demonstrably wrong assumptions in the light of actualized theory of culture and identity. These incorrect conceptual bases provoke counterproductive effects for these populations’ ability to exercise their own rights.
